Auto-renewal Service Agreement
Effective: April 8, 2022
Welcome to use the automatic renewal service.
The automatic renewal service is provided by eWeLink for its users (hereinafter referred to as “you” mostly), which automatically deducts fees from your designated third-party payment account or bank account in accordance with your settings.
Please read and understand the terms of this Agreement carefully and fully, in particular those corresponding to exemption or restriction of liability. eWeLink will prompt you to lay emphasis on restriction and exemption terms by virtue of bold or italic bold fonts. It is worth noting that minors shall read this Agreement in the presence of the legal guardian and confirm the right to bind to other payment accounts.
If you are sure to turn on the automatic renewal service, you are deemed to have read and agreed to be bound by this Agreement. If you disagree with any of the terms of this Agreement, you may turn off this service.
Service contents
In a bid to facilitate you to purchase (or subscribe ) the paid products of eWeLink, we provide you with an automatic renewal service. When you explicitly agree to turn on the automatic renewal service, that is, authorize eWeLink to meet the agreed renewal conditions, the fees of re-purchase of the paid product will be deducted from your binding third-party payment account or bank account. The premise of this service is that you have turned on automatic renewal and bound-related accounts, and the above accounts can be successfully deducted in full.
This service is applicable to products that need regular renewal such as “eWeLink Camera Plan” provided by eWeLink.
Turning on of automatic renewal
After turning on the automatic renewal service, your eWeLink account will be bound with your designated third-party payment account or bank account.
Once you have turned on the automatic renewal service, you are deemed to know and agree that eWeLink will issue a deduction instruction in accordance with the deduction rules of payment channels when the service period of products is about to expire. You are also deemed to agree that the payment channel can deduct the fees of the next billing cycle from your bound account without verifying your account password, payment password, SMS verification code and other information in the light of the deduction instruction issued by eWeLink, and extend the corresponding service content, service conditions and service period.
You know and agree that there may be a display delay in the update of automatic renewal status. Please refer to your renewal status shown in eWeLink APP.
If the renewal failure is not caused by eWeLink (such as third-party system failure, account limit, and insufficient account balance), we will deal with it as “expired non-renewal” and stop providing you with the corresponding service. You shall bear the possible adverse consequences on yourself.
Some Apple users can still buy paid products even without logging into their eWeLink accounts. In such cases, we will record the purchase in the light of the device (IMEI code) used by users to purchase products and bind the third-party payment account or bank account to the device. If you have bought paid products without logging into your eWeLink account, but the device is no longer under your control currently, including, but not limited to, loss or gift to others, you can turn off the automatic renewal service to avoid continuous payment. For the turning off method, please refer to “Cancellation of automatic renewal” in this Agreement.
Promotions and deals
We may adjust products’ prices based on business needs or market, and publicize it to users on relevant pages. In addition to the explicit agreement on the price of each period when the automatic renewal service is turned on for corresponding products, if the automatic renewal price is higher than that of your initial purchase, we will inform you to get your consent. If the price of automatic renewal is lower than that of your first purchase, we will directly deduct the corresponding fees.
If you obtain an extension for the corresponding products through a non-paid purchase way, such as the redeem code, the start time of automatic renewal is extended to the day before the expiration date of your extended products. However, the automatic deduction for iOS is subject to Apple’s rules.
Cancellation of automatic renewal
APP Store will draw your attention to the automatic renewal matters through significant means (such as in-site private messages and SMS) 24 hours before the automatic renewal date. You can renew or cancel the renew at your own option. You can also cancel or change the automatic renewal service at any time while you are using the product that has turned on the automatic renewal, depending on the options shown in the following path or related page. We will not charge you any unreasonable fees for this.
You can turn off the automatic renewal function from a third-party payment account or bank account (or system). Please follow the steps below to turn it off.
Apple device: click on the “APP Store” on Apple mobile device→ click on the image of the Apple account at the upper right corner to enter the “Account” → Subscription→ select “eWeLink” → cancel the subscription;
If operating system upgrade and other reasons make it impossible for you to properly turn off the automatic renewal service, you can consult the device manufacturers or system service providers, or contact our customer service. We will try our best to provide you with a solution.
The cancellation of this service is regarded as the revocation of your authorization to automatically deduct fees from third-party payment accounts or bank accounts given to eWeLink. However, this revocation does not exert an influence on the deduction that eWeLink has completed before your successful revocation.
For any reason, if you stop using the paid products and services, the corresponding automatic renewal service needs to be turned off by yourself. If you do not turn off the service, eWeLink will continue to carry out an automatic deduction. Once the deduction is successful, eWeLink will continue its service.
Agreement modification
eWeLink has the right to modify or change the terms of this Agreement in accordance with the development of the Internet and the changes of relevant laws, regulations, and normative documents, or due to the needs of eWeLink’s business development. Once the content of this Agreement changes, eWeLink will choose to prompt you in ways including but not limited to system prompts, announcements, in-site messages, etc., in accordance with the actual situation.
If you do not agree with eWeLink’s amendment to the relevant provisions of this Agreement, you have the right to turn off the automatic renewal service. If you continue to use it, you will be deemed to have accepted the modifications made by eWeLink to the relevant terms of this Agreement.
Applicable law and dispute settlement
The establishment, effectiveness, performance, interpretation, and dispute settlement of this Agreement shall be governed by the laws of the mainland of the People’s Republic of China. If any provisions of this Agreement are invalid due to conflict with the laws of the mainland of the People’s Republic of China, such provisions shall be reinterpreted for the purpose of being as close as possible to the original provisions of this Agreement, and other provisions of this Agreement shall remain in full force and effect.
This Agreement shall be signed in Longgang District, Shenzhen City, People’s Republic of China. In case of any dispute between you and eWeLink, both parties shall try their best to resolve the dispute through friendly negotiation. If no agreement can be reached through negotiation, both parties agree to submit the dispute to the court having jurisdiction over the dispute.
Others
If eWeLink cannot deduct fees normally due to force majeure or other reasons beyond its control, it will issue a notice in time and deal with the aftermath reasonably.
